Terms of Use

These Terms of Use (the Agreement) explain the terms and conditions by which you may access and use the services provided by Go Clean (referred to herein as Go Clean, we, our, or us). The services shall include, but shall not necessarily be limited to, (a) https://gocleanqld.com, a website-hosted user interface (the Interface or App), (b) an aggregator of various third-party commercial cleaning providers (the Cleaning Service Aggregator) and (c) mobile application. You must read this Agreement carefully as it governs your use of the services. By accessing or using any of the services, you signify that you have read, understand, and agree to be bound by this Agreement in its entirety. If you do not agree, you are not authorized to access or use any of our services and should not use our services.

To access or use any of our services, you must be able to form a legally binding contract with us. Accordingly, you represent that you are at least the age of majority in your jurisdiction (e.g., 18 years old in Australia) and have the full right, power, and authority to enter into and comply with the terms and conditions of this Agreement on behalf of yourself and any company or legal entity for which you may access or use the Interface. If you are entering into this Agreement on behalf of an entity, you represent to us that you have the legal authority to bind such entity.

You further represent that you are not (a) the subject of economic or trade sanctions administered or enforced by any governmental authority or otherwise designated on any list of prohibited or restricted parties or (b) a citizen, resident, or organized in a jurisdiction or territory that is the subject of comprehensive economic sanctions. Finally, you represent that your access and use of any of our services will fully comply with all applicable laws and regulations, and that you will not access or use any of our services to conduct, promote, or otherwise facilitate any illegal activity.

1. Our Services

1.1 The Interface

The Interface provides a web or mobile-based means of access to (a) a scheduling platform that allows users to book professional cleaning services for commercial spaces, and (b) the Cleaning Service Aggregator.

1.2 The Cleaning Service Aggregator

The Cleaning Service Aggregator allows you to discover, compare, and schedule commercial cleaning services across multiple third-party providers (each a Third-Party Cleaning Provider).

2. Bookings

Payment: Bookings for cleaning services are facilitated through a third-party payment processor. We may provide such service providers with information regarding your credit card or other payment instrument. You represent and warrant that such information is true and that you are authorized to use the payment instrument. You will be responsible for all taxes associated with your bookings through the service. Cancellation: Title and risk of loss for all services ordered by you will pass to you at the time of service delivery. We reserve the right to cancel any booking for any reason. Returns: As cleaning services are time-based and labor-based, you acknowledge and agree that cancellations may only be made within our defined cancellation window. Refunds are subject to review. Waiver: Your booking constitutes a waiver of any and all proprietary, personal, and privacy claims relating to the scheduling of service.

3. Modifications to the Terms

We reserve the right, in our sole discretion, to modify the Terms at any time. If we make changes, we will provide you with notice of such changes by providing a notice through the Interface or the App or updating the date at the top of these Terms. Unless we say otherwise in our notice, any modifications are effective immediately, and your continued use of the Interface or the App will confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using the Interface or the App.

4. Modifications to the Interface or the App

We may, at our sole discretion, at any time and with or without prior notice to you, modify, suspend or disable, temporarily or permanently, the Interface or the App, in whole or in part, for any reason whatsoever, including, but not limited to, as a result of a security incident. We will not be liable for any losses suffered by you resulting from any modification to the Interface or the App or from any suspension or termination, for any reason, of your access to all or any portion of the Interface or the App. All of these Terms will survive any termination of your access to the Interface or the App regardless of the reasons for its expiration or termination, in addition to any other provision which by law or by its nature should survive.

5. Restrictions

You agree not to engage in, or attempt to engage in, any of the following categories of prohibited activity in relation to your access to or use of the Interface or the App: Intellectual Property Infringement - Activity that infringes or violates any person or entity’s copyright, trademark, service mark, or other proprietary or intellectual property rights under the law. Cyberattack - Activity that seeks to interfere with or compromise the integrity, security or proper functioning of any computer, server, network, or platform, including (but not limited to) the deployment of malware and denial of service attacks. Fraud or Misrepresentation - Activity that seeks to defraud us or any other person or entity, including (but not limited to) providing any false, inaccurate, or misleading information to unlawfully obtain services or benefits. Any Other Unlawful Conduct - Activity that violates any applicable law, rule, or regulation.

6. Ownership

The Interface and the App are owned and operated by Go Clean. We or our licensors retain all right, title, and interest in and to the Interface, the App and their content (the Content) and any trademarks, logos, or service marks displayed on the Interface, the App or in the Content (the Marks). The Interface, the App, the Content, and the Marks are protected by applicable intellectual property laws and international treaties. Except as expressly authorized by Go Clean, you may not make use of the Interface, the App, the Content, and the Marks.

7. Service Availability

You are responsible for managing your own schedule and service preferences within the Interface. We do not guarantee the availability of any specific time slot or cleaner, and we are not liable for any missed or delayed services due to unforeseen circumstances. Go Clean is not responsible for the acts or omissions of third-party providers.

8. Risk Acknowledgement

By accessing and using the Interface or the App, you represent that you understand and accept the risks inherent in booking third-party cleaning services online. This includes, but is not limited to, delays, cancellations, rescheduling, access issues, or service dissatisfaction. We encourage users to verify details and provide clear access instructions. You acknowledge that Go Clean is a facilitator and not the direct provider of cleaning services.

9. Fees and Price Estimates

In connection with your use of the Interface or the App, you agree to pay all listed service fees, including any applicable taxes or surcharges. Prices shown are estimates based on service type and scope, and may vary depending on the actual work required. You agree that final charges may differ from estimates in cases where the scope of service changes.

10. Taxes

It is your sole responsibility to fulfill any tax obligations related to services booked through the Interface or the App. We recommend consulting with your accountant or tax adviser for guidance. Go Clean does not provide tax advice.

11. Privacy

We collect and use personal information as described in our Privacy Policy. By using the Interface or the App, you consent to such data practices. Your data may be shared with service providers (e.g., cleaners) for operational purposes and with analytics providers to enhance safety and quality. We retain data only as long as necessary to fulfill our business and legal obligations.

12. Links and Third Party Content

The Interface may contain links to third-party services or websites. We do not control or endorse these services, and we are not liable for their content or your use of them. When you leave our Interface, you do so at your own risk. You should review the terms and privacy policies of any third-party service you use.

13. Disclaimer of Warranties

The Interface, the App, and all content and services are provided on an AS IS and AS AVAILABLE basis. Go Clean makes no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access or that the services will be error-free.

14. Release of Claims

You agree to release and hold harmless Go Clean from any and all claims, liabilities, damages, or losses arising from your use of the Interface or services booked through it, including any acts or omissions by third-party service providers.

15. Indemnity

You agree to indemnify and hold harmless Go Clean and its affiliates from and against any claims, liabilities, losses, damages, and expenses (including legal fees) arising out of or in connection with: (a) your use of the Interface or services, (b) your violation of these Terms, and (c) the use of your account by any third party.

16. Limitation of Liability

To the fullest extent permitted by law, Go Clean shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Interface or services. Our total liability to you shall not exceed the greater of AUD $100 or the amount you paid to us in the preceding 12 months.

17. No Professional Advice

Go Clean does not provide professional cleaning certifications, health inspections, or regulatory advice. Any general cleaning tips or information on the Interface is for informational purposes only and does not replace consultation with qualified professionals.

18. General Terms

These Terms, along with our Privacy Policy and any other legal notices published by Go Clean, constitute the entire agreement between you and Go Clean. If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force. You may not assign these Terms without our written consent. We may assign these Terms freely.

19. Governing Law

These Terms shall be governed by the laws of the State of Queensland, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts located in Queensland for any dispute arising under these Terms.

This Privacy Policy (the Policy) explains how Go Clean (Go Clean, the Team, we, us or our) collects, uses, and shares data in connection with the Go Clean web app, website and all of our other properties, products, and services (the Services). Your use of the Services is subject to this Policy as well as our Terms of Use.

Security

We implement reasonable administrative, technical, and physical safeguards to help protect your data from unauthorized access, misuse, or loss. However, no method of transmission over the internet is completely secure. You are responsible for maintaining the security of your login credentials and communications with Go Clean.

Age Requirements

Our Services are intended for general audiences. We do not knowingly collect personal information from children under the age of 18. If you believe we have inadvertently collected such information, please contact us immediately.

Changes to this Policy

If we make material updates to this Policy, we will notify you through the Services. Continued use of our Services indicates your agreement with this Policy and any updated versions.
